NANCY SCHERER analyzes the voting behavior of judges in the United States
Courts of Appeals in criminal search and seizure decisions. She concludes that black
judges appear more willing than white judges to accept claims by criminal defendants
of police misconduct and that in certain cases, race may in fact impact judicial decision
making.
